On September 10th, 2019 the US Department of Labor posted a news release detailing the investigation of a gas station in Long Island City, NY. The DOL’s Wage and Hour Division discovered that the requirements of the Fair Labor Standards Act were being violated, big time. Employees were working more than 40 hours a week but receiving a straight time rate, making less than minimum wage, and there were recordkeeping violations- such as improper time and attendance records, or payroll tracking.
So, what happened? The gas station is to pay back over $200,000.00 in back wages, damages, and penalties. The outcome begs the question, is it worth not having a time tracking system in place? We don’t think so.
The fact of the matter is that these stories are not uncommon, and even worse many times employers don’t even realize they’re violating any standards.
